Nursing home abuse and neglect is inexcusable.

 

As an industry, assisted care facilities and nursing homes are not doing a good job of caring for residents. In too many facilities, money is more important than simply meeting obligations to residents. Elder care facilities are often understaffed. Many do not do an adequate job of screening, training and supervising their staff.  Many elderly care facilities do not have staff that are qualified and trained to perform the job functions for which they are hired.

In recent news, corporate giant Allianz was indicted on RICO charges for selling deferred annuities to the elderly. On March 4, the U.S. District Court for the Central District of California issued its latest ruling in the long-running consolidated class-action saga Negrete v. Allianz Life Ins. Co. of North America (No. CV 05-6838) and Healey v. Allianz Life Ins. Co. of North America (No. CV 05-6838). In this ruling, Judge Christina Snyder dismissed Allianz’s motion for judgment on the pleadings, finding that plaintiffs’ claims under the Racketeer Influenced and Corrupt Organization Act, 18 U.S.C. § 1962(c) (RICO) and California’s “elder abuse” statute, Cal. Welf. & Inst. Code §§ 15610 et seq. (Elder Abuse Act), could proceed. Elder Abuse oocurs more often than you think, in fact it is unfortunately, very common.
